Sealed bids will be received by Lincoln County, NC on July 12, 2012 until 2:00 pm for construction of the “Denver Booster Pump Station Upgrade”, at which time they will be publicly opened and read aloud at 115 West Main Street, Lincolnton, NC 28092.
Bids must be submitted on the complete project and must be enclosed in a sealed envelope, addressed to Lincoln County Managers Office, C/O John Isenhour, CLGPO, Purchasing Office, Third Floor Citizens Center, 115 West Main Street, Lincolnton, NC 28092. Outside of the envelope must be marked “Response to RFB No. 2013-0712 for Denver Booster Pump Station Upgrade, Lincoln County, North Carolina” Envelope must also bear, on the outside, the name of the bidder, the bidder’s address, and the bidder’s Contractor License number. All bids must be made on blank forms provided and included in the bound document, or as may be provided by Addendum prior to bid.

Each proposal shall be accompanied by a cash deposit or certified check, drawn on some bank or trust company insured by the Federal Deposit Insurance Corporation, in an amount equal to not less than five percent of the proposal. In lieu thereof, the bidder may offer a bid bond of five percent of the bid prepared on the Bid Bond form contained within the Contract Documents or a Surety Company's Standard Bid Bond form, duly executed by the Bidder as principal and executed by a surety company licensed under the laws of North Carolina to execute such bonds and listed in the latest issue of U. S. Treasury Circular 570, conditioned that the surety will, upon demand, forthwith make payment to the obligee upon said bond if the bidder fails to execute the contract in accordance with the bid bond. Said deposit shall be retained by the Owner as liquidated damages in event of failure of the successful bidder to execute the contract within ten days after the award or to give satisfactory surety as required by law.
Bidders must comply with the President’s Executive Order No. 11246, as amended, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin.
Lincoln County Government, as awarding authority, and the contractor and subcontractors performing the construction contract awarded shall cooperate and in good faith do all things legal, proper and reasonable to achieve the goal of 10 percent for participation by minority businesses in construction of this project as required by GS 143-128.2. The bidder shall include with the bid proposal the form “Identification of Minority Business Participation” identifying the minority business participation it will use on the project, and shall include with the bid proposal either Affidavit A or Affidavit B as applicable. Forms and detailed instructions are included within the Proposal Form in the bid documents. Failure to complete and submit with the bid proposal all applicable MBE forms is grounds for rejection of the bid. (GS143-128.2c, Effective 1/1/2002.) Documentation of good faith efforts regardless of the MBE/WBE goal obtained is required of the low bidder.
The Contractor shall comply with the Department of Labor Safety and Health Regulations for construction promulgated under the Occupational Safety and Health Act of 1970 (PL91 596) and under Section 107 of the Contract Work Hours and Safety Standards Act (PL91 54), or latest revisions.
General Contractors are notified that "An Act to Regulate the Practices of General Contracting" ratified by the North Carolina General Assembly on March 10, 1925, and as subsequently amended will be observed in receiving bids and awarding General Contracts.
All Qualification Packages, per Paragraph 10. of the Instructions to Bidders, must be submitted at least seven days prior to the advertised bid date.
The Owner reserves the right to reject any or all bids and to waive informalities and technicalities.
Please note the engineer’s estimate is $383,000.
