PreBid Info:   A Mandatory Pre-bid Meeting, Site Tour and MBE/WBE Workshop will be conducted Wednesday, May 23, 2012 at 1pm at the Macon County Airport. The purpose of the Pre-bid Meeting is to inform prospective Contractor’s and Subcontractor’s of the project scope and requirements for meeting the MBE/WBE goals set forth for this contract.

Bid Info:   Sealed proposals will be received by the Macon County Airport Authority in the Conference Room of the Airport Terminal Building, Macon County Airport, 1241 Airport Road, Franklin, NC 28734, up to 1:00 P.M., Wednesday June 6, 2012, and immediately thereafter publicly opened and read for the furnishing of labor, material and equipment for Apron Improvements.

Proposals must be submitted in sealed envelopes with the Bidder’s name, full mailing address, and General Contractor License Number shown as the return address. Sealed envelopes shall be addressed to:

Proposals submitted without the prescribed information may be rejected.

All Bidders should be aware that the date, time, and location for Proposal Submittal and Opening may be modified by Addendum.

Public Notes:
All prospective bidders, including prospective subcontractors are hereby notified that they must have proper contracting licenses under state law for their trades at the time bids are received. General Contractors are notified that applicable statutes of North Carolina will be observed in receiving and awarding general contracts. The General Contractor must have his license number clearly printed or typed on the sealed bid envelope.

The Owner will not accept or consider proposals from any contractor whose name, at the time of opening of bids or award, appears on the then-current list of ineligible contractors published by the Comptroller General of the United States under Section 5.6 (b) of the Regulations of the Secretary of Labor (29) CFR nor a proposal from any firm, corporation, partnership, or proprietorship in which an ineligible contractor who, at the time of the opening of bids or the award, is removed from the Department of Transportation’s list of prequalified contractors.

Each bid shall be accompanied by a bid guaranty consisting of a cash deposit, or a certified check drawn on a bank or trust company insured by the FDIC, or a bid bond executed by a surety company licensed under the laws of North Carolina to execute such bonds. Such Bid guaranty shall be in an amount not less than 5% of the total amount of the bid and will be retained by the Owner as liquidated damages should the successful bidder fail to properly execute the Contract within ten (10) days after the award and to give satisfactory surety as required by law.

By submitting a bid the Contractor certifies that he has under his direct control, or at his disposal, the men, equipment, and materials required to execute this work as specified. Lack of such control or availability of men, equipment, or materials shall constitute failure to properly execute the Contract. Performance and Labor and Material Payment Bonds will be required for 100% of the Contract price, with a surety or sureties legally authorized to do business in North Carolina.

A bid may be withdrawn only as provided by the applicable statutes of North Carolina. If a bid is withdrawn within 90 days of the bid opening, the Bid Guaranty shall be forfeited. If the request to withdraw is made later than 72 hours after the opening of bids, and if the withdrawal is allowed by state and local law, the owner may return the bid guaranty at his option.

The project is conditioned upon receipt of state funding under provisions of the Airport and Airways Safety and Capacity Expansion Act of 1987 and most recently Wendell H. Ford Aviation Investment and Reform Act for 21st Century (AIR-21). Certain mandatory federal requirements apply to this solicitation and will be made part of any contract awarded.

MINORITY/WOMAN BUSINESS ENTERPRISE (MBE/WBE) Policy. It is the policy of the North Carolina Department of Transportation that Minority Business Enterprises (MBEs) and Woman Business Enterprises (WBEs) as defined in GS 136-28.4 shall have equal opportunity to compete fairly for and to participate in the performance contracts financed in whole or in part by State Funds.

The bidder shall make good faith efforts, as defined in Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract Two Percent (2%) MBE and Four Percent (4%) WBE for a total of 6% of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (MBE) and woman owned businesses (WBE). The apparent successful competitor will be required to submit (with the bid) information concerning the MBE's/WBE’s that will participate in this contract. If the bidder fails to achieve the contract goal stated herein, it will be required to provide (within 48 hours after the opening of the bids) documentation demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these requirements will be considered non-responsive. This program is set forth by specification SP1G68 and is included in the contract documents.

The prime contractor and all subcontractor(s) proposed to be used in the bid document shall be prequalified with the NC Department of Transportation. Prequalification for the prime contractor is required at the time of the bid opening. Prequalification for all subcontractor(s) is not required at the time of the bid opening but it is a condition of contract award. Credit toward the MBE/WBE advertised goal will not be counted unless the MBE/WBE to be used is certified by the North Carolina Department of Transportation and whose name at the time of opening of bids appear in the Directory of Transportation Firms published by the North Carolina Department of Transportation. The Owner reserves the right to reject any or all bids and to waive informalities and minor irregularities.
